Terms of Service

Welcome to DigiMealz (“Company”, “We”, “Us”, “Our”).
These Terms govern your use of DigiMealz POS, KOT, Dashboard, Inventory, Reports, Support, and all related software (“Services”).
By creating an account, installing the software, or using DigiMealz, you (“Merchant”, “Customer”, “Restaurant”) agree to these Terms.
If you disagree, do not use DigiMealz.
1. Definitions
- Merchant / Customer: The restaurant or business using DigiMealz.
- User: Anyone accessing DigiMealz under the Merchant’s account.
- Platform: DigiMealz POS, Dashboard, APIs, Cloud Services.
- Data: Menu, orders, invoices, KOT data, customer details, business configs.
- Subscription: Monthly or annual plan enabling access to DigiMealz.
2. Eligibility
You must:
- Be at least 18
- Own or represent a business
- Have authority to bind the business legally
- Not use DigiMealz for illegal activities
3. License to Use
DigiMealz grants you a non-exclusive, revocable, non-transferable license to use the Services.
You may not:
- Reverse engineer
- Copy or resell the software
- Use it to build competing software
- Modify or tamper with core logic
- Share credentials with unauthorized users
4. Subscription & Billing
- Access requires an active paid subscription.
- Plans renew automatically unless canceled.
- You authorize DigiMealz to auto-charge via Razorpay or approved methods.
- Failure to pay → account restrictions → suspension → data access limits.
- Prices can change with 30 days’ notice.
5. Free Trial
We may offer a free trial at our discretion.
Trials convert to paid plans automatically unless canceled.
6. Merchant Responsibilities
You agree to:
- Provide accurate business details
- Maintain confidentiality of login credentials
- Ensure stable internet & power for POS operations
- Ensure staff is trained to use the system
- Keep your devices updated and functional
- Follow GST and accounting laws of India
7. Data Ownership
- All restaurant data belongs to the Merchant.
- DigiMealz may process your data to provide service.
- We may anonymize data for insights & improvements.
- We do not sell personal data.
8. Data Backup & Retention
We take routine backups.
However:
- DigiMealz does not guarantee recovery in cases of:
- Merchant-side device failure
- Incorrect usage
- Accidental deletion by user
- Force majeure events
- Historical data retention: Minimum 6 months (varies by plan).
9. Service Availability
We aim for > 99% uptime.
But we do not guarantee uninterrupted service due to:
- Maintenance
- Connectivity issues
- Server outages
- 3rd-party failures
- Printer or device malfunction
DigiMealz is not responsible for loss of revenue caused by downtime.
10. Support
Support is provided:
- Via WhatsApp
- Via DigiMealz Support Portal
- During business hours (unless higher plan)
Support covers:
- Troubleshooting
- Printer/KOT setup guidance
- How-to queries
Support does NOT cover:
- On-site visits (charged separately)
- Network issues caused by merchant
- Printer hardware replacement
- Device formatting/setup
11. Refund & Cancellation

12. Limits of Liability
DigiMealz is not liable for:
- Loss of business revenue
- Printer malfunction
- Incorrect menu setup by staff
- GST/Tax compliance errors by merchant
- Data loss caused by merchant devices
- Internet/power outages at merchant location
Maximum liability = last 1 month subscription fee.
13. Termination
We may suspend/terminate accounts for:
- Fraud
- Abuse
- Non-payment
- Misuse of system
- Illegal activity
Merchant may terminate anytime. No refunds on unused periods.
14. Governing Law
These Terms shall be governed by Indian law, jurisdiction Udaipur, Rajasthan.
